LAW OF TRADEMARKS
The Law of Trademarks, within the framework of Saudi Arabia’s Corporate Laws & legislations, regulates the registration, protection, and enforcement of trademarks within the country. It provides a legal framework for individuals and businesses to register their trademarks and outlines the rights and responsibilities of trademark owners.
HIGHLIGHTS OF THE LAW OF TRADEMARKS IN SAUDI ARABIA:
- The law defines trademarks as any visible sign capable of distinguishing goods or services, including words, logos, symbols, and combinations thereof.
- Trademark owners are granted exclusive rights to use their marks in relation to the goods or services for which they are registered. They also have the right to prevent others from using identical or similar marks without permission.
- The law specifies acts constituting trademark infringement, such as unauthorized use of a registered mark, and provides legal remedies such as injunctions, damages, and seizure of infringing goods.
- Saudi Arabia is a member of the Gulf Cooperation Council (GCC) and follows the GCC Trademark Law, which provides for regional trademark registration through the GCC Patent Office.
ISSUER OF THE LAW OF TRADEMARKS IN SAUDI ARABIA:
The Ministry of Commerce will establish a register known as the “Trademarks Register” at its competent department. This register will record all registered trademarks, as well as notices of assignment of ownership, transfer, mortgage, attachment, or license to use them. Additionally, it will document details regarding the renewal and cancellation of trademarks, along with any other information stipulated in the Implementing Regulations.
WHO IS SUBJECT TO THE LAW OF TRADEMARKS IN SAUDI ARABIA?
Any individual, business, or entity engaged in commercial activities involving trademarks within Saudi Arabia is subject to the provisions of the Law of Trademarks. This includes local businesses as well as foreign entities operating in the Saudi market.
